These Terms and Conditions ("Agreement") govern your use of the Heirloom Atlas website and your enrolment in any Heirloom Atlas educational programme. By submitting an enquiry form, confirming a booking or attending a programme, you agree to be bound by this Agreement. Please read it carefully before proceeding.

1. Definitions
- "Heirloom Atlas", "we", "us", "our" — refers to the business entity operating under the name Heirloom Atlas, with its principal place of business at 54 Jalan Sultan Ismail, 50250 Kuala Lumpur, Malaysia.
- "Programme" — any educational session, course or consulting engagement offered by Heirloom Atlas, including the Household Mapping Session, the Object Provenance and Photography Programme, and the Museum and Heritage Trust Cataloguing Consulting engagement.
- "Participant", "you", "your" — any individual or organisation that enquires about, books or attends a Programme.
- "Materials" — any documents, templates, worksheets, guides or other content provided to Participants in connection with a Programme.
- "Website" — the Heirloom Atlas website accessible at https://heirloomr.cyou.
2. Acceptance of Terms
By submitting an enquiry, making a payment or attending a Programme, you confirm that:
- You are at least 18 years of age, or are acting on behalf of an organisation with authority to enter this Agreement.
- You have the legal capacity to enter into a binding agreement under Malaysian law.
- You have read and understood these Terms and Conditions in full.
If you are booking on behalf of a heritage trust, museum or other institution, you represent that you have authority to bind that organisation to this Agreement.
3. Programme Descriptions and Scope
Heirloom Atlas provides educational programmes in household document mapping, archival object description and heritage collection cataloguing. The specific scope of each Programme is described on the Website and in the written scope document provided prior to booking.
Important limitations — please read carefully:
- Programmes are educational in nature. Nothing in any Programme constitutes legal advice, financial advice, property valuation, estate planning, probate guidance or any other form of regulated professional advice.
- Any question relating to ownership, distribution, valuation, inheritance or legal administration that arises during a Programme will be noted and referred to an appropriate qualified professional. Heirloom Atlas does not answer such questions.
- The scope of each Programme is fixed at the time of booking. No changes to scope will take effect without written agreement from both parties.
- Programmes are currently available to participants in Malaysia. Delivery outside Malaysia is subject to separate agreement.
4. Booking and Payment
All prices are stated in Malaysian Ringgit (RM) and are inclusive of any applicable taxes unless stated otherwise.
- Household Mapping Session: RM 470 per session (up to 8 participants or private).
- Object Provenance and Photography Programme: RM 1,850 for the full six-week programme.
- Museum and Heritage Trust Cataloguing Consulting: RM 4,660 for the full engagement. A payment schedule will be agreed in writing at the time of booking.
Bookings are confirmed upon receipt of payment or written payment agreement. We accept bank transfer and major credit and debit cards via our payment provider. We do not store card details.
5. Cancellation and Refund Policy
- Cancellation by participant — more than 7 days before session: full refund, less any payment processing fees.
- Cancellation by participant — 3 to 7 days before session: 50% refund of the programme fee.
- Cancellation by participant — fewer than 3 days before session: no refund. The session may be rescheduled once at our discretion.
- Cancellation by Heirloom Atlas: full refund of any amount paid, with the option to reschedule at no additional cost.
- Institutional consulting engagements: cancellation terms are agreed in writing at the time of booking and form part of the engagement agreement.
Refunds are processed within fourteen working days of a valid cancellation request to [email protected].
6. Participant Responsibilities
As a participant, you agree to:
- Attend sessions at the agreed time and location, or notify us at least 24 hours in advance if you cannot attend.
- Use Materials provided for personal, non-commercial purposes only, unless a separate written licence is granted.
- Respect the confidentiality of other participants in group sessions.
- Not record, photograph or otherwise reproduce session content without prior written consent.
- Provide accurate information when making a booking or submitting an enquiry.
7. Intellectual Property
All Materials, templates, worksheets, guides and programme content produced by Heirloom Atlas remain the intellectual property of Heirloom Atlas. Participants are granted a personal, non-transferable licence to use Materials for their own household or institutional archive purposes.
You may not resell, reproduce, distribute or adapt Materials without written permission. The floor plan, index sheet, photographs and descriptions you produce during a Programme belong entirely to you — we make no claim over them.
8. Disclaimers
- Heirloom Atlas provides educational content. We make no representation that any specific outcome will result from participation in a Programme.
- Condition assessments, storage recommendations and description templates are provided for educational purposes only and do not constitute professional conservation, legal or financial advice.
- We do not assess the monetary value of any object. We do not advise on ownership, succession or distribution of any property.
- The Website and Materials are provided on an "as available" basis. We do not warrant that the Website will be uninterrupted or error-free.
9. Limitation of Liability
To the maximum extent permitted by Malaysian law, Heirloom Atlas shall not be liable for any indirect, incidental, consequential or special damages arising from your participation in a Programme or use of the Website, including but not limited to loss of data, loss of anticipated savings or any claim arising from a third party.
Our total aggregate liability to you under this Agreement shall not exceed the amount you paid for the relevant Programme. Nothing in this clause limits liability for fraud, personal injury caused by our negligence, or any liability that cannot lawfully be excluded under Malaysian law.
10. Indemnification
You agree to indemnify and hold harmless Heirloom Atlas, its staff and contractors from any claims, losses, costs or expenses (including reasonable legal fees) arising from your breach of this Agreement, your misuse of Materials, or any claim by a third party arising from information you provided to us.
11. Confidentiality
Group sessions are conducted under mutual confidentiality. Each participant agrees not to disclose personal information shared by other participants during a session. Heirloom Atlas staff observe the same obligation. This clause survives termination of this Agreement.
12. Termination
Either party may terminate a Programme booking by written notice. Termination by you is subject to the cancellation and refund terms in clause 5. We reserve the right to terminate a booking without refund if a participant's conduct disrupts a session or breaches this Agreement in a material way.
Clauses 7, 8, 9, 10 and 11 survive termination.
13. Governing Law and Dispute Resolution
This Agreement is governed by the laws of Malaysia. Any dispute arising under or in connection with this Agreement shall first be referred to informal negotiation between the parties for a period of thirty days.
If informal resolution fails, the dispute shall be submitted to the exclusive jurisdiction of the courts of Kuala Lumpur, Malaysia. Nothing in this clause prevents either party from seeking urgent injunctive relief.
Consumer participants may also raise complaints with the Tribunal for Consumer Claims Malaysia (TTPM) at www.ttpm.gov.my.
14. General Provisions
- Entire agreement: This Agreement, together with the written scope document for your Programme, constitutes the entire agreement between you and Heirloom Atlas in respect of the Programme.
- Severability: If any clause is found unenforceable, the remaining clauses continue in full force.
- Waiver: Failure to enforce any provision does not constitute a waiver of our right to enforce it in future.
- Assignment: You may not assign your rights under this Agreement without our prior written consent. We may assign our rights in connection with a business transfer.
- Notices: Formal notices must be sent by email to [email protected] or by post to 54 Jalan Sultan Ismail, 50250 Kuala Lumpur, Malaysia.
15. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated by email to registered participants or by notice on the Website at least fourteen days before they take effect. Continued participation in a Programme after the effective date constitutes acceptance of the updated terms.
